decided to go for appeal re dla Options

Hi all, after a few days thinking about my refusal for dla I have decided to go for it and appeal! I had a word with them today and the girl on the helpline was really helpful and have me some good advice. So here goes!! Once the appeal is lodged it could take up to 11 weeks! considering I put the original claim in in April, it may be sorted one way or another by Christmas!!!!

It could be worth it , and definitely read that link i posted in your other thread :) .. it's a very good leaflet.
Hope it goes well and depending on where you are 11 weeks could be a bit optimistic , current wait here is about 5 months :O

Thanks everyone, Ive posted the letter today, and paid for guaranteed delivery on Monday. When I rang to ask advice the lady I spoke to said that I had been given the wrong advice when I made to request for a reconsideration. I was asked then to explain my symptoms on a bad day. This is wrong apparently. This lady told me to list all the daily things I couldnt do and explain why ie chopping veg due to pain in wrist, carrying laundry downstairs as unable to carry heavy things due to back pain etc etc. Well Ive made a list and here's hoping.

I'll keep you posted.

Hi Heather ,

well as long as you stated that the letter was an appeal , and that you were appealing the decision to refuse DLA because you fit the criteria for one of the components , and included your NI number then the appeal should be accepted, and will progress to Tribunal .
Reconsiderations are rarely successful unless very good evidence is supplied.

In any case if you appeal immediately then it is automatically reconsidered by the DWP.

Next step will be an information form from the Tribunals service asking whether you have a representative and whether you wish to have a written consideration or you wish to attend in person.This form needs to be completed and returned within 14 days !!.
It should be noted that people who attend themselves , either with representation or not are more successful than the written submission option.

Meanwhile it is preferable to get more evidence as stated in the leaflet i quoted between now and the tribunal. The Tribunal is about how you were at the time of your application and does not consider if your care and mobility needs have increased since then . If your care or mobility needs have increased , also re -apply for DLA .

Good luck and definitely look at the leaflet and download a copy DLA appeals, it would have even told you how to write your appeal letter and what the DWP are after.

Invariably people fail to get DLA purely down to the fact that they haven't given enough information for the DWP Decision Maker to make a correct decision. It is about what you can and cannot do within certain parameters , not what your symptoms are .

Hi Heather, good luck with your appeal, I won mine back in August after appealing against their original decision in Nov 2009. I used CAB who were supportive and helpful and came along with me and my daughter to the interrogation ThumpUp ....Eileen
